Anal Examination In Kenya To Prove Homosexuality Is Legal: Court

Homosexuality is illegal in Kenya and on Thursday high court judge Matthew Emukule said forced anal examinations for gathering evidence to prove such crime comes with sufficient justification under Kenyan law.

Two unnamed men have been prosecuted for having gay sex. They challenged the authorities in court for intrusion into human body to prove sexually related crime.

Both the men deny the gay sex charges and Rights groups have regularly condemned such examinations as well as such laws that disallow gay sex.

Homosexual acts are illegal in many African countries and such forced examinations are still being practiced. New York-based Human Rights Watch said such anal tests are considered as torture under international law.

Amnesty’s regional director Muthoni Wanyeki said the Thursday’s ruling was unacceptable as well as absurd as proving consensual homosexual activity shouldn’t bother the government.

In his visit to Kenya in July 2015, the US President Barack Obama said such inequality leads to the path where freedoms start to erode.

Meanwhile, the trial of both the men for having gay sex is ongoing.
