Who is to be blamed if self-driving cars crashes and causes damage to properties. Who is to take responsibility of someone dies in the accident. The questions still don’t have proper legal answer, but Volvo and Tesla have come forward to take responsibility for any faults in their software as autonomous vehicle legislation is currently in its infancy and will take some years in an evolutionary process.

Meanwhile, Comma AI’s CEO George Hotz, also commonly named as geohot, said he will not take responsibility for any accidents if caused by his software that is downloaded free for self-driving vehicle.

He said, “It’s not my code, I did not release it” and the code is released and maintained by Comma AI Inc.

The disclaimer page of Comma. AI Inc. reads, “THIS IS ALPHA QUALITY SOFTWARE FOR RESEARCH PURPOSES ONLY. THIS IS NOT A PRODUCT. YOU ARE RESPONSIBLE FOR COMPLYING WITH LOCAL LAWS AND REGULATIONS. NO WARRANTY EXPRESSED OR IMPLIED.”

It is also learned geohot is technically protected by the standard MIT open source license.

The open source software is presently in a legal grey area and it has been declared as “free speech” and protected under the First Amendment.

Software too has a fuzzier legal status. It is not a “product,” as argued by lawyers and judges and downloaders would need to heed the expression “Buyer Beware.”
